Terms of Service

These Terms of Service ("Terms") govern your access to and use of CreateCV.io (the "Service"), operated by CreateCV.io ("we," "us," or "our"). Please read these Terms carefully before using the Service.

By accessing or using CreateCV.io — including browsing the website, creating an account, or using any feature — you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and CreateCV.io. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

CreateCV.io is an AI-powered resume and cover letter builder delivered as a web-based Software-as-a-Service (SaaS) application. The Service allows you to:

• Create, edit, and manage professional resumes and cover letters
• Choose from a library of professionally designed templates
• Use AI-powered tools to generate and improve content
• Download your documents as styled PDF files
• Check your resume's compatibility with Applicant Tracking Systems (ATS)
• Track job applications (where available)

The Service is available through a web browser. We may update, modify, or discontinue features at any time with reasonable notice.

To use certain features of CreateCV.io, you must create an account. By creating an account, you agree to the following:

• Age Requirement: You must be at least 16 years old in the European Union or at least 13 years old in the United States to create an account and use the Service. If you are under the required age, you may not use CreateCV.io.
• Accurate Information: You must provide accurate, current, and complete information during registration and keep your account information up to date.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials (email and password). You are responsible for all activities that occur under your account. Notify us immediately at [email protected] if you suspect unauthorized access.
• One Account Per Person: Each individual may only create and maintain one account. Creating multiple accounts to circumvent free tier limits or for any other purpose is prohibited.

You retain full ownership of all content you create, upload, or provide through CreateCV.io, including your resume content, cover letter text, and any other materials ("User Content").

By using the Service, you grant CreateCV.io a limited, non-exclusive, revocable license to host, store, display, and process your User Content solely for the purpose of providing and improving the Service. This license includes the right to send your content to AI providers for content generation features (see AI Processing Disclosure).

We do not claim any intellectual property rights over your User Content. Your resumes and cover letters belong to you. When you delete your account, your User Content is permanently removed from our systems in accordance with our Data Retention Policy.

You represent and warrant that you have all necessary rights to the content you provide and that your User Content does not infringe upon any third party's intellectual property or other rights.

CreateCV.io offers AI-powered features that assist with writing, improving, and suggesting content for your resumes and cover letters. By using these features, you acknowledge and agree to the following:

• Assistance, Not Automation: AI features provide suggestions and recommendations to assist you. The final content is always your responsibility, and you maintain full editorial control.
• Review and Verify: You are responsible for reviewing, editing, and verifying all AI-suggested content before including it in your documents. AI outputs may contain errors, inaccuracies, or information that does not reflect your actual experience.
• No Uniqueness Guarantee: AI-generated suggestions may not be unique. Similar suggestions may be provided to other users who have similar roles, industries, or qualifications.
• No Accuracy Guarantee: We do not guarantee the accuracy, completeness, or suitability of AI-generated content for any particular purpose. You should not rely solely on AI suggestions without your own judgment.
• Third-Party Processing: AI features involve sending your content to third-party AI providers (Anthropic and OpenAI) for processing. Please refer to our Privacy Policy for details on how this data is handled.

You agree not to use CreateCV.io in any way that is unlawful, harmful, or that violates these Terms. Specifically, you must not:

• Scrape or Automate: Use bots, scrapers, or any automated tools to access, collect data from, or interact with the Service without our prior written consent.
• Reverse Engineer: Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service or any underlying technology.
• Illegal Content: Create, upload, or distribute content that is illegal, defamatory, fraudulent, harassing, threatening, or that violates the rights of others.
• Impersonation: Create resumes or cover letters that impersonate another person or misrepresent your identity, qualifications, or experience with intent to deceive.
• Service Interference: Interfere with or disrupt the operation of the Service, its servers, or networks connected to the Service, including introducing malware or denial-of-service attacks.
• Credential Sharing: Share your account credentials with others or allow others to access your account.
• Circumvention: Attempt to bypass any security measures, rate limits, or access restrictions of the Service.

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice, depending on the severity of the violation.

CreateCV.io operates on a subscription-based model with a 7-day free access period:

7-Day Free Access

All new users receive 7 days of full free access to all Pro features. During this period, you have complete access to every feature at no cost. To start, you must create an account and provide a valid payment method. You will not be charged during the 7-day free access period.

Automatic Annual Subscription

Once your 7-day free access period ends, you will be automatically subscribed to the annual plan at the then-current price, unless you cancel before the free period expires. Current pricing is displayed on our Pricing page.

Auto-Renewal Disclosure

IMPORTANT — Please read carefully (CA Bus. & Prof. Code §17600 et seq., NY GBL §527-a, IL 815 ILCS 601):

• When you sign up, you receive 7 days of full free access. If you do not cancel before the 7 days end, you will be automatically subscribed to the annual plan and charged the then-current annual subscription price.
• After the initial subscription, your annual plan automatically renews at the end of each billing period unless you cancel before the renewal date.
• Upon renewal, you will be charged the then-current annual subscription price using the payment method on file.
• You can cancel your subscription at any time from your Account Settings. Cancellation is just as easy as subscribing — no phone calls, emails, or hidden steps required.
• We will send you a reminder email before your free access expires and before each subsequent renewal, including the date and price you will be charged.
• Prices may change with at least 30 days' notice. If you do not agree with a price increase, you may cancel before it takes effect.

All new users receive 7 days of full free access to all Pro features. The following terms apply:

• Payment Method Required: You must provide a valid payment method (credit card, debit card, or other accepted method) to start. Your payment method will not be charged during the 7-day free period.
• Full Access: During the 7 days, you have access to all Pro features, including unlimited templates, AI-powered tools, PDF and DOCX downloads, and all premium functionality.
• Automatic Annual Subscription: At the end of the 7-day free period, you will be automatically subscribed to the annual plan at the then-current price, unless you cancel before it ends.
• Cancellation: You can cancel at any time from your Account Settings to avoid being charged. You will retain access until the 7-day free period ends.
• Reminder Notifications: We will send you a reminder email before your free access period expires, notifying you of the upcoming subscription date and the annual price you will be charged.
• One Per Person: The 7-day free access is limited to one per person. Creating multiple accounts to obtain additional access is prohibited.

You may cancel your subscription at any time. Here is how cancellations and refunds work:

• Easy Cancellation: Cancel from your Account Settings at any time. The cancellation process is as simple as the subscription process — no phone calls, emails, or complex procedures are required.
• During 7-Day Free Access: If you cancel during your 7-day free access period, you will not be charged. You will retain access to Pro features until the free period ends.
• After Automatic Subscription: Once the 7-day free period ends and you are automatically subscribed to the annual plan, you may still cancel at any time. After cancellation, you will continue to have access to Pro features until the end of your current annual billing period.
• Annual Plan Refunds: If you cancel your annual subscription within the first 14 days of being charged (after the free period), you are eligible for a pro-rated refund for the unused portion. After 14 days, no refund is available.
• Refund Requests: To request a refund, email [email protected] within 14 days of your charge. For full details, see our Refund Policy.

We strive to provide a reliable and highly available service, but we cannot guarantee 100% uptime.

• Best Effort: We aim to maintain high availability and will endeavor to resolve outages as quickly as possible.
• Scheduled Maintenance: We may occasionally perform maintenance that could cause temporary downtime. We will provide advance notice via email or in-app banner whenever feasible.
• Force Majeure: We are not liable for downtime or performance issues caused by circumstances beyond our reasonable control, including natural disasters, internet outages, third-party service failures, or government actions.

We are not liable for any loss, damage, or inconvenience caused by Service downtime or unavailability.

To the maximum extent permitted by applicable law:

• The Service is provided on an "AS-IS" and "AS-AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use the Service.
• Our total aggregate liability to you for all claims arising from or related to the Service is limited to the amount you paid to CreateCV.io in the 12 months preceding the claim, or $100 USD, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

You agree to indemnify, defend, and hold harmless CreateCV.io, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of the Service or any activity under your account
• Your User Content, including any claims that your content infringes the rights of a third party
• Your violation of these Terms or any applicable law or regulation
• Your misuse of AI-generated content, including any misrepresentation of qualifications or experience

This indemnification obligation survives the termination of your account and these Terms.

We want to resolve disputes fairly and efficiently. If a dispute arises between you and CreateCV.io, please try to resolve it informally by contacting us at [email protected] first.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to conflict of law principles.

Binding Arbitration

If we cannot resolve a dispute informally within 30 days, any remaining dispute, controversy, or claim shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will be conducted in English, and the arbitrator's decision will be final and binding.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted on an individual basis only, not as part of a class, consolidated, or representative action. You waive the right to participate in a class action lawsuit or class-wide arbitration.

Exceptions

The following are exempt from the arbitration requirement:

• Claims that qualify for small claims court in your jurisdiction
• Actions to obtain injunctive relief to prevent irreparable harm
• Disputes where mandatory local law requires a different dispute resolution mechanism (for example, EU consumers may always bring claims in their local courts)

Either party may terminate this agreement:

• By You: You can delete your account at any time from your Account Settings. Upon deletion, we will remove your data in accordance with our Data Retention Policy.
• By Us: We may suspend or terminate your account if you violate these Terms, engage in fraudulent or illegal activity, or if we are required to do so by law. For non-severe violations, we will attempt to provide notice and an opportunity to cure the violation before termination.

Surviving Provisions: The following sections survive termination of your account or these Terms: User Content & Ownership, Limitation of Liability, Indemnification, Dispute Resolution, and any other provisions that by their nature should survive.

We may modify these Terms from time to time. When we make changes:

• Material Changes: We will notify you via email and/or a prominent in-app notice at least 30 days before the changes take effect.
• Non-Material Changes: Minor clarifications or formatting updates may be made without advance notice but will be reflected in the "Last Updated" date.

Your continued use of CreateCV.io after the 30-day notice period constitutes your acceptance of the updated Terms. If you do not agree to the changes, you should stop using the Service and delete your account before the changes take effect.
